5 Statutory Principles
The Mental Capacity Act seeks to balance a person’s right to make their own decisions and the need to protect them where they lack mental capacity to make those decisions. The Act sets out the five statutory principles (Table below) that anyone making any decision or taking any action for a person who appears to lack capacity must apply.
